1. Overview
This website is operated by EarMen LLC. Throughout the website, the terms “EarMen,” “we,” “us” and “our” refer to EarMen LLC.
EarMen provides this website, including all information, tools, products and services available through it, subject to your acceptance of these Terms of Service and all policies referenced herein.
By visiting the website or purchasing from us, you use our Service and agree to these Terms of Service, our Shipping Policy, Return Policy, Warranty Policy and Privacy Policy. If you do not agree, you must not use the Service or place an order.
Our online store is hosted by Shopify Inc., which provides the e-commerce platform through which products are offered and sold.
2. Online store terms
By accepting these Terms, you confirm that you have reached the age of majority in your country, state or province of residence, or that you have reached the age of majority and authorized any minor dependents under your responsibility to use this website.
You may not use our products or Service for any illegal or unauthorized purpose or violate any applicable law, including intellectual-property and copyright laws. You must not transmit viruses, malicious code or other destructive material.
3. General conditions
We may refuse, restrict or terminate Service where reasonably necessary and to the maximum extent permitted by applicable law.
Content other than payment-card information may be transferred across networks and technically adapted to network or device requirements. Payment-card information is encrypted during transmission.
You may not reproduce, duplicate, copy, sell, resell or exploit any part of the Service without our written permission.
4. Information on the website
We make reasonable efforts to keep website information accurate and current. Information may occasionally be incomplete, outdated or incorrect. Historical information is provided for reference only.
We may correct errors and update website content, subject to existing orders and applicable law.
5. Products, availability and prices
Certain products may be available exclusively online, in limited quantities, by preorder or with a stated production lead time. Availability estimates are not guarantees unless expressly confirmed in writing.
We make reasonable efforts to display product images, colors, descriptions and specifications accurately. Actual appearance may vary depending on the customer’s screen, device and lighting.
Product descriptions, specifications, availability and prices may change without notice. We may discontinue a product at any time. Offers are void where prohibited.
Unless expressly stated, we do not guarantee that a product will meet every customer’s subjective preferences or expectations.
6. Orders and customer information
We may refuse, limit or cancel an order where reasonably necessary, including suspected fraud, sanctions or export restrictions, unauthorized resale, a material pricing error, unavailable inventory or incorrect customer information.
We may limit quantities purchased per person, household, company, account, billing address, shipping address or payment method.
If we change or cancel an order, we may contact the customer using the email address, billing address or telephone number supplied with the order.
The customer must provide complete and accurate purchase, billing, shipping and contact information and promptly provide any additional information reasonably required to process payment, customs clearance or delivery.
7. Payment, taxes, duties and import charges
Prices are displayed in the currency selected for the customer’s market. The customer agrees to pay the total amount shown at checkout, including product price, shipping charges and taxes or fees displayed before the order is placed.
Orders delivered to European Union member states and the United States are shipped DDP — Delivered Duty Paid.
For European Union orders, the displayed price includes applicable VAT and any import duties or customs-clearance charges applicable to the shipment.
For United States orders, EarMen covers applicable import duties, tariffs and customs-clearance charges. Any applicable state or local sales tax may be calculated and charged at checkout.
Unless checkout or the order confirmation explicitly states otherwise, orders delivered outside the European Union and the United States are shipped DAP — Delivered at Place.
For DAP shipments, the customer is responsible for all applicable import duties, VAT, GST, taxes, customs-clearance fees, brokerage charges, import permits and other costs or requirements imposed by the destination country. These amounts are not included in the product price or shipping charge unless explicitly displayed and collected at checkout.
Where required, the customer is responsible for acting as the importer of record and providing information, identification, authorization, permits or documentation requested by the courier or customs authorities.
By placing an order and accepting these Terms and our Shipping Policy, the customer acknowledges and accepts the DDP or DAP terms applicable to the selected delivery country.
8. Shipping and delivery
Processing times, delivery estimates, shipping charges and applicable shipping terms are described in our Shipping Policy.
Shipping and delivery times are estimates unless expressly guaranteed in writing. We are not responsible for delays caused by courier services, customs authorities, local authorities, holidays, weather, incorrect delivery information, failed delivery attempts, force-majeure events or circumstances outside our reasonable control.
Risk of loss or damage passes in accordance with applicable law and the agreed shipping terms.
9. Refused or undeliverable shipments
If a customer refuses delivery, fails to collect a shipment, abandons a shipment or provides incorrect or incomplete delivery information, the customer may be responsible for the original shipping cost, return shipping cost, re-shipping cost, courier storage fees, customs-related charges, payment-processing fees and other direct costs incurred by EarMen, to the extent permitted by applicable law.
10. Returns, refunds and cancellations
Returns, refunds, cancellations and replacements are governed by our Return Policy and applicable consumer-protection laws.
To request a return, cancellation, refund or replacement, contact sales@earmen.com and provide the order number, product name and a clear explanation of the request.
Refunds may be issued after the returned product has been received and inspected, unless applicable law requires otherwise. Shipping charges, payment-processing fees, customs-related charges and other direct expenses may be deducted where permitted by law and described in our policies.
Nothing in these Terms limits mandatory cancellation, return, refund or consumer rights.
11. Warranty
Products are covered by our published Warranty Policy and by mandatory statutory warranty rights applicable in the customer’s country or region.
Warranty coverage does not extend to damage caused by misuse, improper handling, unauthorized repair or modification, incorrect connection, unsuitable accessories, accidental damage or use contrary to product instructions, except where applicable law provides otherwise.
A customer requesting warranty service must provide proof of purchase and reasonable information about the reported defect.
12. Third-party tools and links
We may provide access to third-party tools, websites, products or services that we do not control. Their use may be subject to separate terms and policies imposed by the relevant third party.
To the extent permitted by law, we are not responsible for the content, accuracy, security, availability or practices of third-party services.
13. Reviews, comments and submissions
If you submit reviews, comments, photographs, ideas or other materials, you grant EarMen a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, translate, publish and distribute them for legitimate business and promotional purposes, subject to applicable privacy and intellectual-property laws.
You must not submit unlawful, misleading, abusive, defamatory, obscene or infringing material, malicious software or content that violates another person’s rights.
We may moderate or remove content that violates these Terms or applicable law.
14. Personal information
Personal information submitted through the store is processed according to our Privacy Policy and applicable data-protection laws.
15. Errors and omissions
The website may occasionally contain typographical errors, inaccuracies or omissions relating to descriptions, specifications, prices, promotions, shipping charges, delivery estimates or availability.
We may correct material errors and update information. Where permitted by law, we may cancel an order affected by a material pricing or availability error and refund all amounts paid for that order.
16. Prohibited uses
You may not use the website or Service for unlawful, fraudulent, deceptive, abusive, infringing or harmful purposes; to transmit malware; to collect personal information unlawfully; to spam, phish or scrape; to bypass security measures; or to interfere with the website, servers, systems or business.
We may suspend or terminate access for a material violation of this section.
17. Disclaimer of warranties
We do not guarantee that the Service will always be uninterrupted, timely, secure or error-free.
Except for warranties expressly stated by EarMen or required by law, the Service and products are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim implied warranties and conditions, including merchantability, satisfactory quality, fitness for a particular purpose, durability, title and non-infringement.
Nothing in these Terms excludes or limits a warranty or consumer right that cannot legally be excluded or limited.
18. Limitation of liability
To the maximum extent permitted by law, EarMen LLC and its affiliates, directors, officers, employees, agents, contractors, suppliers, service providers, partners and licensors are not liable for indirect, incidental, special, punitive or consequential loss, including lost profits, revenue, savings or data, arising from use of the Service or products purchased through it.
Where a jurisdiction does not permit an exclusion or limitation, liability is limited only to the maximum extent permitted. Nothing excludes liability for fraud, intentional misconduct, personal injury caused by negligence or other liability that cannot legally be excluded.
19. Indemnification
To the maximum extent permitted by law, you agree to indemnify EarMen LLC and its affiliates, directors, officers, employees, agents, contractors, licensors, service providers, suppliers and partners against third-party claims arising from your unlawful use of the Service, violation of these Terms or infringement of another party’s rights.
This section does not apply where prohibited by applicable consumer law.
20. Severability
If any provision is found unlawful, invalid or unenforceable, it will be enforced to the maximum extent permitted or severed where necessary. The remaining provisions continue in effect.
21. Termination
These Terms remain effective until terminated by you or us. You may stop using the Service at any time. We may suspend or terminate access if you materially violate these Terms, misuse the Service or engage in unlawful or fraudulent activity.
22. Entire agreement
These Terms, together with our published policies and terms shown at checkout, constitute the entire agreement governing use of the website and purchases made through it.
A failure to enforce a provision does not waive it. These Terms replace prior versions concerning the same subject matter.
23. Governing law and consumer rights
These Terms and purchases from EarMen LLC are governed by the laws applicable to EarMen LLC in the State of Illinois, United States, without depriving a consumer of mandatory protections or rights available under the laws of the consumer’s country or region.
24. Changes to these Terms
We may update these Terms by posting a revised version on this page. Where required by law, material changes will apply only after appropriate notice. Continued use after changes become effective constitutes acceptance to the extent permitted by applicable law.
